Applying For a Grant of Probate

When someone passes away with a Will, there could be a requirement to have their Will probated. When someone passes away without a Will, there is legislation in place to determine how their assets will be distributed and who will be able to act as the administrator of the estate.  If someone passes away with property or assets in their name as sole owner but did not have a Will, a Grant of Administration (also known as Letter of Administration), will be required to appoint someone as the administrator of the estate.
